By securing a charter or utilizing our Service, you consent to be bound by these Terms. If you do not accept any part of these terms, then you are prohibited from accessing the Service.
2. Service Overview
GreenBloomSpace offers luxe yacht charter services, which include but are not limited to:
- Daily yacht hires
- Evening cruises
- Business retreats
- Exclusive events
- Extended charters
Availability and weather conditions may affect our services. We retain the authority to adjust or cease services at our discretion.
3. Booking and Reservations
3.1 Booking Process
To reserve a charter, the following conditions must be met:
- Be at least 18 years old
- Submit accurate and complete details
- Remit the necessary deposit as indicated in your booking confirmation
- Concur with these Terms & Conditions
3.2 Confirmation
A booking is confirmed only after payment is made and you receive our written confirmation. Booking acceptance is at our sole discretion.
3.3 Availability
Charter availability is contingent upon the vessel's availability and favorable weather conditions. We will strive to accommodate your desired dates and timings.
4. Payment Terms
4.1 Pricing
All our fees are denominated in € and incorporate any relevant taxes, unless specified otherwise. Prices are subject to change without prior notice.
4.2 Payment Schedule
- Initial Deposit: 50% of the total charter cost payable upon booking
- Remaining Balance: Payable 48 hours before the charter departs
- Incidental Fees (if incurred): Payable at the end of the charter
4.3 Payment Methods
We accept major credit cards, electronic bank transfers, and certified bank drafts. We employ secure, encrypted methods for payment processing.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With more than 72 hours before departure: Full refund minus any processing fees
- Between 24-72 hours prior to departure: 50% refundable
- Less than 24 hours before departure: Non-refundable
5.2 Weather Cancellations
In the instance of unsafe weather as determined by our captain, options to:
- Rebook your charter for the next viable date at no extra cost
- Provide a complete refund if rescheduling isn't an option
5.3 Mechanical Issues
If the assigned vessel encounters mechanical issues, we will endeavor to offer a comparable alternative. If this isn't possible, a full refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All guests are mandated to:
- Adhere to all directives from the crew
- Don safety equipment as required
- Disclose any medical conditions that may affect their safety or well-being
- Stay within designated areas aboard the vessel
6.2 Prohibited Items
The following are disallowed on board:
- Glass containers
- Illegal drugs
- Weapons of any kind
- Excessive beverages (beyond a moderate quantity)
- Pets (unless given prior approval)
6.3 Conduct
Individuals must behave respectfully at all times. We reserve the right to terminate a charter without refund if a guest's conduct is deemed unsafe or interrupts the experience for others.
7. Liability and Insurance
7.1 Our Liability
Our liability is confined to the monies paid for your charter. We do not accept responsibility for:
- Injuries incurred by passenger malfeasance
- The loss or damage of personal belongings
- Indirect, resultant, or punitive damages
- Delays due to weather or unanticipated circumstances beyond our control
7.2 Insurance Coverage
We maintain extensive marine insurances for our vessels and operations. Clients are expected to have their own travel and personal insurance arrangements.
7.3 Assumption of Risk
Engaging in our charter services signifies acknowledgment of the intrinsic risks involved in marine activities and you accept personal accountability for your safety and actions.
8. Modifications and Itinerary Changes
We hold the right to alter itineraries, courses, or timelines due to weather, safety, or operational prerequisites. We aim to offer equivalent substitutes when necessary.
9. Force Majeure
We are not responsible for delays, voidances, or changes compelled by incidents beyond our control, which include, yet are not limited to:
- Extreme weather events
- Natural catastrophes
- Legal regulations
- Port shutdowns
- Technical failures
10. Privacy and Data Protection
Your private information is treated according to our Privacy Policy. By engaging with our services, you consent to your data being utilized as explicated within our Privacy Policy.
11. Intellectual Property
All material on our website, which includes texts, graphics, trademarks, and images, is safeguarded by copyright and trademark laws. Any reproduction, distribution, or creation of derivatives is forbidden without prior written consent.
12. Governing Law
These Terms are subject to the laws of Monaco. All disputes are to be adjudicated by the courts situated in Monaco, Monaco.
